Federal and state statutes and regulations have a significant impact on product liability litigation. Safety regulations carry the imprimatur of considered judgment by a governmental agency. Parties often battle over whether the manufacturer has complied with those regulations, and courts have wrestled with the effect of regulations in product liability cases. In recent years, state legislatures have also adopted legal standards for dealing with these issues. The article addresses some considerations for counsel in offering or defending against evidence of safety regulations.
